Man charged with vehicular homicide arrested once more for DUI

Old wounds may have been recently reopened for the family of a 47-year-old Nashville man who was killed in a fatal motor vehicle accident on April 19, 2013. That's because the driver of the vehicle that hit him, the 42-year-old bassist for the band 3 Doors Down, was recently arrested in Mississippi for once again driving under the influence. Although no one suffered injury this time around, the musician's recent arrest shows a pattern of negligent behavior that could be pointed out in future civil litigation.

For those of our readers who may not remember, the crash took place off Interstate 40 when the musician, who admitted to using alcohol and prescription drugs earlier, clipped the 47-year-old's pickup truck. This caused the victim to lose control of his vehicle, which slammed into a guardrail before going down an embankment and overturning. He was ejected from the vehicle and died from his injuries at a Tennessee hospital.

Although reports do not indicate whether the victim's family has sought legal representation or whether they intend on taking a claim of wrongful death to court, it's possible that the musician's most recent DUI arrest may prompt them to do so if they have not already.  

As we mentioned before, hearing the most recent news about the musician's arrest may interfere with their grieving process, especially considering the fact that his negligent actions could have resulted in another serious, if not fatal, accident.  And while sentencing from the criminal courts may hold the musician responsible for his actions, so too may the civil courts if a personal injury claim is filed.
