Suit: Labor boss trashed company on Facebook – –

Electricians’ union official urged readers to do no business with cable manufacturer

So much for the old “sticks and stones” adage.

A European cable manufacturer has filed a defamation lawsuit against an Armonk labor union official, claiming he tarnished the company’s image by posting nasty comments on its Facebook page.

Nexans Network Solutions claims in papers filed in state Supreme Court in White Plains that Dylan Wiley, business agent for Local 1430 of the International Brotherhood of Electrical Workers, “has injured and threatens to continue to injure NNS” by trashing the company on the social-media site.

“These statements are false,” according to the lawsuit, which was filed Friday. “NNS is a Belgium company and neither it nor its division (Nexans Cabling Solutions) has any facilities or employees in the United States. Accordingly, it cannot have violated any United States labor, health or safety laws or regulations.”

But Wiley wasn’t done. On Monday, he posted again on the company’s Facebook page regarding the lawsuit.

“They are doing this in retaliation for profiling Nexans Energy as a company that commits unfair labor practices and OSHA violations, which they in fact do,” said Wiley, of Mount Kisco. “Please do not do business with ‘Nexans Cabling Solutions’ as they are attempting to suppress my free speech in violation of the 1st amendment.”

Nexans Network Solutions and Nexans Cabling Solutions, on whose Facebook page Wiley commented, are subsidiaries of French-based Nexans S.A. The company, a leading manufacturer of copper and optical fiber cables, said those companies do not have facilities or employees in the United States.

But the company said it also has “indirect subsidiaries” that include Nexans Energy USA, which owns and operates a plant in New York’s Orange County. The lawsuit said the Chester facility “manufactures a variety of cable and wires for use in commercial buildings and other structures.”

Local 1430 represents electrical workers throughout the New York metropolitan area, including in Orange County.

Union officials did not return calls for comment Monday.

According to the lawsuit, Wiley had posted the allegations against the company on earlier Facebook posts.

“This company commits unfair labor practices and commits constant violations of OSHA laws,” Wiley wrote in a March 3 comment. “Do not give this company any business.”

Nexans said it has asked Facebook to take down Wiley’s comments, but that the site has refused to do so. The page in question is a Facebook business page, which gives the user no control over the “rantings and reviews” section where Wiley allegedly posted his comments, the lawsuit said.

Officials at Nexans declined to discuss the case further on Monday.
